PHOTO RELEASE ACKNOWLEDGMENT
I hereby authorize New Era Boxing Club to publish photographs taken of me, and my name, and likeness, for use in New Era Boxing Club’s print, online and video-based marketing materials, as well as other publications. I hereby release and hold harmless New Era Boxing Club from any reasonable expectation of privacy or confidentiality for myself and/or any minor child and/or children associated with the images specified above. I further acknowledge that participation is voluntary and that neither I and/or the minor child or children will receive financial compensation of any type associated with the taking or publication of these photographs or participation in New Era Boxing Club’s marketing materials or other publications. I acknowledge and agree that publication of said photos confers no rights of ownership or royalties whatsoever. I hereby release New Era Boxing Club, its contractors, its employees, and any third parties involved in the creation or publication of marketing materials, from liability for any claims by me or any third party in connection with my participation and/or the minor.

COVID-19 LIABILITY WAIVER AND ASSUMPTION OF RISK
In consideration of being allowed to participate in activities or other programs, or being on premises of New Era Boxing Club, the below signed participant, and the participant’s parent(s) or legal guardian(s) if the participant is a minor, agrees as follows:
I am aware that the novel coronavirus (“COVID-19”) is an extremely contagious virus and that it is currently believed that COVID-19 spreads through person-to-person contact.
I am familiar with the Center for Disease Control and Prevention (”CDC”) guidelines regarding COVID-19, which are located at https://www.coronavirus.gov and https://www.cdc/gov/coronavirus/2019-ncov/index.html. I acknowledge and understand that the circumstances regarding COVID-19 are changing from day-to-day, and that the CDC guidelines are regularly modified and updated. I accept full responsibility for familiarizing myself with the most recent updates, and making informed choices to take precautionary measures to protect myself and others.
In addition to the CDC guidelines, I agree to abide by any and all policies or postings published to the general public at New Era Boxing Club.
By signing this agreement, I acknowledge that I am aware of the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 at the Facility, and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Facility may result from the actions, omissions, or negligence of myself and others.
I agree that, in the event that I suspect I became exposed to or infected by COVID-19 at the Facility and I elect to seek testing and/or treatment as a result therefrom, I will be responsible for payment of any and all medical services and testing services.
I voluntarily, choose to assume all of the foregoing risks and accept sole responsibility for any injury, illness, permanent disability, or death related to COVID-19 arising from or in connection with my presence at New Era Boxing Club. I hereby release and hold harmless the Facility, their employees, agents, directors, officers and representatives and other participants from and against all liabilities (statutory or otherwise) for claims, suits, demands, judgments, costs, interest and expense (including but not limited to attorney’s fees and disbursements) for injury, illness, permanent disability, or death related to COVID-19 arising from or in connection with mine or my child(ren)’s presence at the Facility, EVEN IF ARISING FROM THE NEGLIGENCE, ACTS OR OMISSIONS OFTHE RELEASED PARTIES.

WAIVER OF LIABILITY FOR NEW ERA BOXING CLUB
I hereby understand and acknowledge that the training, programs and events held by New Era Boxing Club may expose me to many inherent risks, including accidents, injury, illness, death or other consequences. I assume all risk of injuries associated with participation and I am aware of the potential dangers incidental to engaging in boxing/fitness activities which include but are not limited to strains, sprains, tears, and broken bones. In the event that I am injured, I agree to assume any financial obligation, either through personal health insurance, or through some other means, for any medical costs which incurs. New Era Boxing club assumes no responsibility for any medical expenses, injury, or damage suffered with the use of the facilities, equipment or services in connection with the boxing/fitness training class(es).
I am aware that I will be engaging in a range of activities including, but not limited to jumping, stretching, turning, lifting, punching, and twisting. I hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in activity. I acknowledge that I am physically fit and mentally capable of performing the physical activity I choose to participate in. Because of the physical demands of boxing and/or personal defense I understand that I must be in good physical condition to participate. I understand that in case of injury, the only medical treatment New Era Boxing Club will provide is first aid.
SPARRING ACTIVITIES
I fully understand that if I engage in sparring at New Era Boxing Club, sparring is most definitely a contact activity, and I also fully understand that I will engage in “pro-style maneuvers” and I will also be subjected to being punched and placed in “pro-style maneuvers.” I understand that it is probable that I will get injured participating in sparring, or I may injure others at New Era Boxing Club. I fully understand that sparring will involve physical contact, and controlled violence. Given that I am familiar with the given inherent violent nature of sparring as a means of putting the skills learned in class to the test, developing an extreme sense of self-confidence, overcoming fear, as well as any other positive goals, I agree not to hold New Era Boxing Club, or any instructors, agents, or employees of New Era Boxing Club liable for any injuries, illnesses, or any physical, emotional, or mental conditions occurred before, during or after sparring. Conditions include, but are not limited to sprains, strains, broken bones, head trauma, dental injuries, eye injuries, nasal injuries, ear injuries, gonad injuries, asthma attacks, post-traumatic stress disorder (or any other such mental disorders).
In the event that any damage to equipment or facilities occurs as a result of my or anyone associated with me willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.
After having read this waiver and knowing these facts, and in consideration of acceptance of my participation in the New Era Boxing Club, I agree, for myself and anyone entitled to act on my behalf, to HOLD HARMLESS, EXEMPT AND RELIEVE the New Era Boxing Club, its officers, agents, employees, organizers, representatives, and successors from any responsibility, liabilities, demands, or claims for any and all personal injury, wrongful death, or property damage resulting from my participation in the New Era Boxing Club training, programs and/or events.
